Federal Judge Orders Freedom of Abrego Garcia from ICE Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to face human smuggling allegations, he was held in federal detention.

In her decision, the court noted that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal challenge center on disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in Tennessee.

Conditions of Freedom

The court, who was hearing his challenge to removal in a federal court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
